Status Update as of January 22, 2019
The City of Olympia received part of the application for an appeal on January 15, 2019. The City of Olympia deemed this appeal application untimely and not effective to initiate the appeal.

Status Update as of January 14, 2019
City staff (including the SEPA Official) reviewed all of the comments received on the Revised Mitigated Determination of Non-significance (MDNS) and concluded that withdrawing or further revising the MDNS is not warranted. In making this determination, the SEPA Official considered provisions in WAC 197-11-340 and concluded: 1) there were no substantial changes to the proposal that would result in significant adverse environmental impacts, 2) no new information was submitted identifying significant adverse environmental impacts, and 3) mitigation measures in the Revised MDNS are appropriate for mitigating offsite traffic and stormwater impacts.
As stated in the Revised SEPA MDNS that was issued on December 27, 2018, an appeal can he filed:
Pursuant to RCW 43.21C.075 (3) and Olympia Municipal Code 14.04.160(A), the conditions (mitigating measures), or lack thereof, in an MDNS may be appealed by any agency or aggrieved person.
Appeals must be filed with the Community Planning and Development Department at the address above within twenty-one (21) calendar days of the date of issue. Any appeal must be accompanied by an Appeal of an Administrative Decision Form and a $1,000.00 administrative appeal fee.

The Hearing Examiner issued an order on December 18, 2018 continuing the hearing and returning the SEPA MDNS to City Staff for further consideration. See the Order from the Hearing Examiner for more details.

The Hearing for the Wellington Heights project took place on December 10, 2018. At the hearing the Hearings Examiner requested city staff to address procedural process for amending the Mitigated SEPA Determination and keep the hearing open for such. Status Update as of October 26, 2018
October 24, 2018 -The Site Plan Review Committee (SPRC) made their recommendation to the Hearing Examiner to approve the preliminary plat subject to condition. The list of the conditions discussed at this meeting is available below. Please note, these conditions are in draft form and subject to modification as the hearing examiner staff report is written.
October 26, 2018 - A Mitigated SEPA Determination of Nonsignificance and Hearing Notice was issued. The SEPA Determination has 3 mitigation measures (conditions), a comment period of 14 days and a 21 day appeal period. See the notice and SEPA Checklist with agency comments below for more details.
December 10, 2018 is the date scheduled for the hearing and will take place in the council chambers at 6 p.m. The staff report to the hearing examiner will be available to the public at least 7 days prior to the hearing. Public comments can be submitted to the lead Planner listed below up to the hearing and will be provided to the hearing examiner for consideration. Public testimonies are allowed at the hearing.
Status Update as of October 22, 2018
The Site Plan Review Committee will be making their recommendation on October 24, 2018 at 9 a.m. meeting. This meeting will take place in the council chambers.
Status Update as of October 12, 2018
City staff has finalized our review and this project will be scheduled to go onto the Site Plan Review Committee agenda soon to make recommendation and all parties of record will be provided notice of such. This meeting is open to the public, but it is not a hearing and public testimonies will not be taken.
The SEPA Determination and hearing notice is also scheduled to be issued in the next few weeks. Notification will be sent to all parties of record and property owners in the area.
Time is allotted for public testimonies at the hearing and all public comments received prior to the hearing will be provided to the hearing examiner for consideration.

On June 4, 2018, the City sent the Land Use Review Letter to the applicant (see link below to access the cover letter, Substantive Review Table and related attachments). The purpose of this letter is to inform the applicant what revision need to be made in order to meet certain codes and standards an identifies information needed in order for city staff to complete their review and make a recommendation to the hearing examiner.

A public hearing is required as part of the review of this project, however it has not yet been scheduled. Prior to the hearing, the property will be posted and property owners and any parties of record will receive additional notice once the hearing is scheduled.
